The Constitution

Approved By General Body With Amendments.

1. Name and Identity

The name of the organization is: Kuwait Pakistan Friendship Association. The initials KPFA are used as a rightful substitute.

The term Association shall be used in this document, which stands for Kuwait Pakistan Friendship Association.

The Association shall be a non-political and non-partisan entity.

The Association shall not represent the governments of either of the two nations or any of the organs thereof.

2. Insignia

Insignia hereunder is used as an identification mark for the association.

3. Mission

To cultivate mutual sentiments of friendship between the two communities of the brotherly nations of Kuwait and Pakistan, living in Kuwait, through the conduct of a variety of socio-cultural, religious and welfare activities.

4. Objectives

The Association will conduct activities in order to achieve the following objectives:

a. To conduct programs of special interest for the Kuwaiti and Pakistani communities on the occasions of national, religious and social significance.

b. To promote commercial, economic, academic and legislative ties of the two nations through exhibits, exchange, awareness activities, etc.

c. To provide welfare assistance for medical treatment and educational pursuit in such cases where the need is appropriately established.

5. Membership

Any Pakistani or Kuwaiti citizen shall be eligible to become a member of the Association by expressing intent and paying a membership fee of Kuwaiti Dinar 5.000 per annum.

6. Organs

The Association shall be composed of the following three organs:

a. General Body: It shall be composed of the entire body of membership. It shall be the supreme body empowered to frame or amend constitution, elect Executive Council, and approve annual reports of performance and finances, submitted to it by the Executive Council in the annual meeting. The General Body shall meet at least once every year. The Executive Council shall be responsible to convene Annual Meeting. The Secretary General of the Association, with the consent of the President, shall be authorized to convene a meeting of the General Body. If more than 50% of the total membership submit a signed call for the meeting of the General Body, it shall be incumbent upon the Secretary General to convene the meeting within two weeks from the date the notice is served.

b. Executive Council: The Executive Council shall be responsible to frame policies, make decisions, conduct activities, generate finances, and prepare reports. The General Body shall elect the following members of the Executive Council for two years through secret ballot.

Members, Executive Council:

The General Body shall elect six members from amongst its membership.

5b.1 Whenever the Executive Council deems it essential for its functioning, it shall be competent to co-opt any of the members of the Association as an additional incumbent in a role and with a title, which shall be determined by the Council. Such decisions shall be effective only during the tenure of an Executive Council.

5b.2 In case any office bearer or member of the Executive Council is no more available to serve his/her role, the Executive Council shall be competent to co-opt any one from amongst the membership to fill-in the role.

5b.3 The Chief Executive of the Association shall be the President. The office of the Patron shall be primarily advisory in nature.

5b.4 The Executive Council shall be empowered to form standing or special-purpose committees.

c. Advisory Council: The Council shall consist of 20 members to be nominated by the Executive Council from amongst the membership; ten each from amongst the two groups of Pakistani and Kuwaiti nationals. The Advisory Council shall be convened by the Secretary General and shall also be attended by the Executive Council. Its deliberations shall be advisory in nature so as to provide policy advice to the Executive Council.

7. General Rules of Business

6.1 The quorum for all the meetings of the three organs shall be the presence of a minimum of 40% of the actual strength of the respective body.

6.2 The decisions requiring a vote shall be determined through simple majority of those present in a meeting. However, changes in constitution or moves of no confidence shall require two-third majority of the active membership of the Association.

8. Elections

The Executive Council shall appoint an Election Officer in the month of November of every odd year who shall make arrangements for the notifications of list of membership and conduct of elections for all office bearers and members of the Executive Council. The process shall be completed before 15 December and the new Executive Council shall become functional effective the first day of the following January.

Addenda

Note about the Interim Arrangement:

A 14-month interim arrangement shall be in place effective November 2000 with the task to formalize constitution and pioneer efforts in order to streamline restructuring and rejuvenation of the Association.

9. Amendments

Amendment 9.1

Clause 6.1 is amended to: The quorum for all the meetings of the three organs shall be the presence of a minimum of 40% of the actual strength available in Kuwait of the respective body.

Amendment 9.2

Space for signatures shall be provided in the Membership Form.

Amendment 9.3

Clause 4. Membership is further defined and expanded for Annual Renewal Dates and Life Membership with following amendments:

9.3.1 KPFA membership is open to every Pakistani and Kuwaiti citizen regardless of his or her political or religious affiliation.

9.3.2 Membership of the members shall be valid until 31st December of a calendar year.

9.3.3 Membership renewal period will be from 1st January to 31st March of each calendar year. During this period reminders will be sent to the members. Membership will be deactivated if a member does not renew his/her membership by paying annual membership fee before 31st March every year.

9.3.4 Anyone entitled to membership can become a lifetime member by paying KD 50/-.

9.3.5 Membership number assigned to a member will not be reused if a member decides not to renew his membership.

Amendment 9.4

KPFA Pakistan Chapter shall be formed consisting of former KPFA members, who have already returned to Pakistan.

Amendment 9.5

KPFA Ladies Auxiliary Committee shall be formed to encourage family's participation in the association's programs and activities.  

Amendment 9.6 (Jan 9, 2004)

"Secretary, Electronic Media" title has been changed to "Secretary Electronic Media and Publications" in the office bearers list of the KPFA Constitution, for the purposes of extending the role of this office bearer to fulfill its KPFA future needs.

Amendment 9.7 (Jan 9, 2004)

Following lines have been added to Clause 5.c Advisory Council:

KPFA Secretary General will invite KPFA Advisory Council Members to attend KPFA monthly regular meetings every four months as observers. 

KPFA Executive Council regular monthly meeting approved minutes shall be emailed to the Advisory Council Members for their information, as confidential documents.

Amendment 9.8 (Jan 9, 2004)

Following lines have been added to Clause 7 Elections:

Only those Members will be eligible to vote or contest, who have paid their Annual Membership Fees.

New Members will be eligible to vote or contest if they have become KPFA Members by completing their membership procedure 30 days prior to the Election Day.
